Someone finishes a shift, gets paid in cash or cashes a check, and wants part of it in Bitcoin before the weekend. They have done it before, they know roughly what they want to spend, and they are in and out in about ten minutes. The second most common is the opposite trade. Someone has held coins for a few years, needs the money for something specific, and wants cash in hand today rather than a bank transfer that clears on Tuesday. That trade takes longer, mostly because we count the money twice. Both are walk-ins. Neither needs an appointment. If you are bringing more than about $10,000 it helps to call ahead so the right amount of cash is on hand, and if you are selling, calling ahead is the difference between same-hour and same-day. ## What the trade costs, and how to check There is one trade fee, and you see it before you agree to anything. The screen shows the live market rate, the fee in dollars, and the amount of Bitcoin you end up with. You approve it, then you pay. Nothing is deducted after the fact. That is worth checking anywhere you trade, not just here. The real cost of a Bitcoin purchase is the fee plus the spread, which is the gap between the market price and the price you were actually given. A machine can advertise a small fee and still take a large cut in the spread. California now requires kiosks to print that spread on the receipt, which makes it easy to compare: add the two numbers, then judge. What can be executed and when depends on size and timing, so ask when you call and you will get a straight answer rather than an optimistic one. ## Keep the receipt Every sale produces a printed receipt showing the coins, the rate, the fee and the dollars. Selling Bitcoin is generally a taxable event in the United States, and the paperwork your accountant will want is exactly this. If you want $80 of Bitcoin at eleven at night, a kiosk down the street is genuinely the better answer and the drive is not worth your time. Machines are open when we are closed, and they are everywhere. What they cannot do is go above $1,000 in a day, sell you cash in most cases, set up a wallet with you, or answer a question. If none of those matter for the trade in front of you, use the machine. That ceiling comes from the Digital Financial Assets Law, passed as AB 39, and it has applied since January 1, 2024. The same law caps what a kiosk can charge you at the greater of $5 or 15%, and requires the machine to hand you a receipt showing its fee and how far its price sat from a licensed exchange. The cap applies to unattended machines. It does not apply to a staffed counter, where you can trade far more with a person in front of you. ## The rule, in one line California Financial Code section 3902: an operator may not accept or dispense more than one thousand dollars in a day from or to a customer through a digital financial asset transaction kiosk. That is the whole limit. It is a per-customer, per-day ceiling, not a per-transaction one, so four $250 purchases in an afternoon hit it just as surely as one $1,000 purchase. The rule binds the operator, not you. There is nothing to apply for and no tier to unlock. A kiosk that offers to go higher is breaking state law, and the operator is the one exposed. ## What counts as a kiosk The law defines a digital financial asset transaction kiosk as an electronic machine that lets a customer buy or sell digital assets on the spot, whether it is a standalone box in a gas station or a terminal bolted to a counter. The defining feature is that the machine handles the trade. Three things are outside the definition, and outside the cap: - Online exchanges. Coinbase, Kraken and the rest are licensed differently and have their own limits, usually tied to your funding method rather than the calendar day. - Staffed counters. When a licensed business serves you in person, verifies your ID and executes the trade for you, the kiosk chapter does not apply. The daily amount is set by the business's own compliance program. - Peer-to-peer trades. Selling to someone you found online is not a kiosk transaction. It is also where most cash-trade robberies happen, which is a different problem with the same solution. ## Three rules that apply to every kiosk in California The kiosk chapter is short. Three parts of it change what you experience at the machine. - The daily cap — section 3902, since January 1, 2024. $1,000 per customer per day, counted across that operator's machines, not reset by using a different one down the road. - The fee cap — section 3904, since January 1, 2025. An operator cannot collect more than the greater of $5 or 15% of the US dollar equivalent of the Bitcoin in the transaction, measured against the publicly quoted price on a licensed exchange when you start it. Note what that means in practice: 15% is the legal maximum a kiosk may charge, and the industry has been pricing near the ceiling for years. It is not a discount. - Disclosure and receipt — section 3905. Since January 1, 2025, the operator has to give you the terms in writing before the transaction, in English and in whatever language it advertised to you in. The receipt has to show the fees collected and the spread between the price you got and the price at a licensed exchange. ## Read the spread line on the receipt The receipt requirement is the most useful part of the law and the least known. A kiosk's headline fee is not the whole cost. The other half is the spread: the gap between the exchange price of Bitcoin and the price the machine gave you. A kiosk can advertise a modest fee and still take a large cut in the spread, and for years there was no way for a customer to see it. Now the receipt has to state it. If you use a kiosk, keep the receipt and read that line. Add the fee and the spread together and you have the real cost of the trade. Compare that number, not the advertised percentage, against what any other option would have cost you. This is the same math we do out loud at the counter before you pay, which is why we tell people to ask for it everywhere. ## How the law arrived - October 2023. The Governor signs AB 39, creating the Digital Financial Assets Law and a dedicated chapter for kiosks. - January 1, 2024. The $1,000 daily cap takes effect, along with receipt requirements and an obligation for operators to report every kiosk location to the state. - January 1, 2025. The fee cap and the written pre-transaction disclosure take effect. - September 2024. AB 1934 moves the licensing deadline from July 1, 2025 to July 1, 2026. - July 1, 2026. Operating without a DFPI license or a completed application on file is no longer allowed. The DFPI has since brought enforcement actions under the law, including orders requiring operators to refund customers. ## Why the cap exists The daily limit was written as a fraud control, not a tax. In the cases that drove the bill, victims were told by someone on the phone to withdraw cash and feed it into a kiosk, often several thousand dollars at a time, and the money was gone the moment the transaction confirmed. A $1,000 ceiling does not stop that conversation, but it slows it down and it caps a single day's damage. The practical effect for everyone else is that a kiosk is now only useful for small amounts. If you are buying more than $1,000, the machine was never going to be the right tool. ## What to do when you need more than $1,000 Two options remain, and they split cleanly on whether you are holding cash. - An exchange , if the money is in a bank account and you are comfortable doing it yourself. No daily cap in the kiosk sense, but no cash either, and a first transfer can take days to clear. - A staffed counter , if you are holding cash or you want a person to do the trade with you. Government agencies, utilities, banks and police never ask for payment in Bitcoin, and no legitimate business needs you to do it at a kiosk today. For larger amounts funded by bank transfer, the all-in cost is usually the lowest of the three options. Where it falls short. No cash. Bank transfers take days to clear before you can withdraw coins. Your coins sit in the exchange's custody until you move them, and accounts get frozen for compliance reviews with no warning. The romance or "pig butchering" scam Someone you met online builds a relationship over weeks or months, then introduces an investment opportunity with amazing returns. The app they show you is fake, the early "profits" are bait, and the money is gone the moment you send it. The tell: you have never met this person, and the relationship always circles back to money. ### 2. The government or utility impersonator A caller claims to be the IRS, the police, or your power company. There is a warrant, a fine, or a shutoff, and the only way to fix it right now is to deposit cash into a Bitcoin machine. No government agency or utility accepts payment through a Bitcoin ATM. Not one, not ever. ### 3. The fake support call Your "bank" or a "crypto exchange" calls about suspicious activity and needs you to move funds to a safe wallet they provide. Real institutions never ask you to move money to protect it. The safe wallet is the scammer's wallet. ### 4. The giveaway or celebrity double-your-coins post Send one coin, get two back, endorsed by a famous face. It is always fake. There is no giveaway, and there never has been. ### 5. The job or overpayment scam A new employer or buyer sends you a check, asks you to buy crypto with part of it and send it on. The check bounces days later and you are out the crypto. Anyone who pays you and asks you to forward crypto is using you to launder or steal. ## Red flags that end the conversation - Urgency. Every scam has a countdown. Real institutions give you time. - Secrecy. You are told not to tell your bank, your family, or the store clerk what the money is for. - Payment by crypto only. Legitimate bills can always be paid another way. - Guaranteed returns. Nobody can guarantee crypto profits. Anyone who does is lying. - A wallet address someone else gave you. If you did not create the wallet, it is not yours. ## What our staff will never do As a FinCEN-registered Money Services Business, we verify ID on every trade, and our team is trained to spot coached customers. We will never ask you to send coins to an address we provide for "verification". We will never rush you. This period is set by the recordkeeping requirements that apply to us as a FinCEN-registered Money Services Business under the Bank Secrecy Act, and we cannot delete these records earlier on request. - Website contact form and enquiry data — twenty-four (24) months from your last interaction with us, unless it forms part of a transaction record. - Marketing and email list data — until you unsubscribe or ask us to remove you, and then no more than twelve (12) months in a suppression record so that we do not contact you again. - Website analytics and advertising data — in line with the retention settings of the providers listed in Section 5, and no longer than twenty-six (26) months. ‍ When a retention period ends, we delete or de-identify the data. If you ask us to delete your data, we will do so except where we are legally required to retain it, and we will tell you if that is the case. ## 7. How We Protect Your Personal Data In order to protect your security, we use the strongest available browser encryption and store all of our data on servers in secure facilities. All data is only accessible to our employees. Our employees are bound by strict confidentiality agreements and a breach of this agreement would result in the employee's termination. DESCRIPTION OF SERVICES The Bitcoin Store operates staffed retail locations in San Jose and Stockton, California, where customers can buy Bitcoin and other supported digital assets with cash, and sell supported digital assets for cash, in person and over the counter with a member of our staff. We also provide bank wire and over-the-counter (OTC) trading, a courier service, and a concierge service for qualifying customers. Rates are quoted and locked at the time of the trade, and all in-person transactions require a valid government-issued photo ID. The Bitcoin Store does not custody digital assets on your behalf, does not operate an exchange or trading platform, and does not offer interest-bearing accounts, lending, staking or investment products. Digital assets you purchase are transferred to a wallet address that you own and control. Services and supported assets may change over time. You agree that The Bitcoin Store will not be held responsible for any losses arising from using the Site or Services. 2.1. COINworKs Inc. operates this Site, thebitcoinstore.com, for its staffed over-the-counter retail stores in San Jose and Stockton, California, and operates coinworks.info for its Bitcoin ATM kiosk network. The two sites describe different ways of transacting with the same company. Your use of coinworks.info is governed by the terms of service published on that site. ## 3. COMPLIANCE As a Money Service Business (“MSB”) registered with the Financial Crimes Enforcement Network (“FinCEN”), we have certain duties to know our clients, keep records of the transactions, employ an Anti-Money Laundering (“AML”) Compliance Program, and have a dedicated Compliance Officer to monitor the transactions. We perform audits and tests of the veracity of our program and have a zero-tolerance policy when it comes to compliance. If you violate any portion of our compliance requirements, we reserve the right, at any time and for any reason, without explanation, to terminate your ability to use our services. We collect and record certain information from our customers. You acknowledge that we will analyze and validate your identity to determine whether you qualify to perform a transaction (“Verification Process”). Your use of the Services may be delayed during the Verification Process, and we disclaim responsibility for any loss, delay or other harm relating to the delay or denial. If you do not pass the Verification Process, or if you fail to provide any of the information required to perform a transaction, you may be denied access to the Services. RISK DISCLOSURES; ASSUMPTION OF RISKS, RELEASE OF The Bitcoin Store When buying or selling cryptocurrency, you are voluntarily choosing to engage in a sophisticated and risky financial transaction. You agree that you have had whatever opportunity you deem necessary to investigate the The Bitcoin Store Services, laws, rules, or regulations that may be applicable and that you are not relying upon any statement of law or fact made by The Bitcoin Store relating to the legality of selling cryptocurrency. The foregoing disclaimers apply to the maximum extent permitted by law. ## 5. PRIVACY POLICY Please refer to our privacy policy for information on how The Bitcoin Store collects, uses, and shares your information. ## 6. GENERAL SERVICE TERMS 6.1. Dispute Resolution ‍ The Bitcoin Store reserves the right to resolve issues and disputes at its sole discretion. Users agree to bear the costs arising from the process of dispute resolution. ‍ 6.2. Accuracy of Information ‍ Users must provide any information required by any screen displayed within the Services. You represent and warrant that all information you provide via the Services is accurate and complete in all respects. ‍ 6.3. Compliance with Law; Taxes ‍ You are responsible for complying with all applicable laws related to your use of the Services, including any and all applicable taxes. Unacceptable Use or Conduct ‍ You will not: ‍ - Violate any law, regulation, contract, intellectual property or other third-party right, or commit a tort while using the Services; - Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services in any manner; - Use any robot, spider, crawler, scraper, or other automated means or interface not provided by The Bitcoin Store to access the Services or to extract data; - Use or attempt to use another user’s account without authorization; - Introduce any malware, viruses, or other harmful material to the site; - Develop any third-party applications that interact with our Site without our prior written consent, or unless otherwise agreed; - Provide false, inaccurate, or misleading information; ‍ 6.5. Service Fees ‍ The Bitcoin Store charges a service fee on each transaction. Your exact rate, spread and fees are quoted to you before you confirm the transaction and are itemized on your receipt. We do not charge fees that are not disclosed to you before you confirm. Any applicable tax is additional. ‍ For California residents, total charges on a transaction do not exceed the greater of $5.00 or 15% of the transaction, as required by the California Digital Financial Assets Law. See the California Disclosures and Customer Protections for the full fee disclosure. ‍ We may adjust our fees from time to time. We will provide at least 14 days’ advance notice before any change to our fees or to the material terms that apply to your transactions. ‍ 6.6. Transaction Errors, Cancellation and Refunds ‍ Once a digital asset transaction is confirmed on the network it is final and cannot be reversed, recalled or cancelled, and no stop-payment right is available. Before you confirm a transaction you may cancel it at no charge. ‍ If you believe a transaction was unauthorized, mistaken or accidental, contact us at info@thebitcoinstore.com or (888) 811-2646 as soon as possible and within 60 days of the transaction. We will acknowledge your report within 3 business days and notify you of the outcome within 30 days. Where a transaction has not yet been broadcast, or where we have charged a fee in error, we will refund the amount in question. Because confirmed blockchain transactions are irreversible, recovery may not be possible once a transaction has been sent, including where you have provided an incorrect receiving address. ‍ To file a complaint, contact us using the methods above. We will acknowledge your complaint within 5 business days and notify you of the resolution within 30 days. California residents may also file a complaint with the California Department of Financial Protection and Innovation as described in the California Disclosures and Customer Protections . ## 7. DISPUTE RESOLUTION; ARBITRATION; WAIVER OF CLASS ACTION All disputes, controversies or claims arising out of or relating to these Terms or the Services, will be resolved through JAMS arbitration in the State of California. The arbitration will be administered by JAMS under its rules in effect at the time the demand is filed, including the JAMS Consumer Arbitration Minimum Standards where those apply. Any in-person hearing will take place in the county where you live, or at another location you and The Bitcoin Store agree on. Nothing in this section prevents either of us from bringing an individual claim in small claims court, or from asking a court for injunctive relief. Nothing in this section limits your right to file a complaint with the California Department of Financial Protection and Innovation or any other regulator, as described in the California Disclosures and Customer Protections . With respect to disputes subject to arbitration pursuant to this section 13, both you and The Bitcoin Store are giving up the right to litigate (or participate in as a party or class member) those disputes in court before a judge or jury. ## 14. GOVERNING LAW The interpretation and enforcement of these Terms, and any dispute related to these Terms or the Services, will be governed by and construed and enforced in accordance with the laws of the State of California without regard to conflict of law rules or that would cause the application of the laws of any other jurisdiction. You agree that The Bitcoin Store may initiate a proceeding related to the enforcement or validity of The Bitcoin Store’ intellectual property rights in any court having jurisdiction. You waive any objection to the venue in any such courts. ## 15. MISCELLANEOUS 15.1. Remedies ‍ If you violate any of these Terms, The Bitcoin Store may, as it determines reasonably necessary to remedy or mitigate your violation, and restrict your use of the Services. The Bitcoin Store Affiliates and Contractors ‍ An “Affiliate” is, with respect to a legal entity, another legal entity that controls, is under common control with, or is controlled by the first legal entity. To the extent that an Affiliate of The Bitcoin Store, or contractor of The Bitcoin Store or an Affiliate of The Bitcoin Store, is operating or providing any Services, the Affiliate or contractor’s provision of such Services will be under terms identical to these Terms substituting the Affiliate or contractor’s name wherever The Bitcoin Store’ name occurs in these Terms. ‍ 15.3. Non Waiver ‍ The Bitcoin Store's failure or delay in exercising any right, power, or privilege under these Terms shall not operate as a waiver thereof. ‍ 15.4. Severability ‍ The invalidity or unenforceability of any of these Terms shall not affect the validity or enforceability of any other of these Terms, all of which shall remain in full force and effect. ‍ 15.5.
